Terms and Conditions of Use - BIGWIN Betting Platform
1. Definitions
- Platform refers to BIGWIN, the digital interface through which wagering services are offered.
- User denotes any individual or entity that creates an account and engages with the Platform for the purpose of placing bets.
- Event signifies any contest, match, or activity, sporting or otherwise, listed on the Platform for wagering purposes.
These definitions are intended to ensure clarity and prevent interpretative ambiguity throughout this Agreement.
2. Acceptance and Modification of Terms
2.1 By accessing or utilizing the Platform, the User irrevocably agrees to be bound by these Terms and Conditions.
2.2 The Platform reserves the unilateral right to amend, revise, or update these Terms at any time, without prior notice. Continued use of the Platform constitutes acceptance of the revised Terms.
2.3 Amendments may be necessitated by changes in applicable legislation, regulatory directives, or operational exigencies. Users are responsible for reviewing the Terms periodically to remain informed of any modifications.
3. Wagering and Payout Conditions
3.1 In the event that more than fifty percent (50%) of active Users correctly predict the outcome of a single Event, the Platform reserves the right to declare all associated wagers null and void.
3.2 In such cases, the Platform may, at its sole discretion, refund stakes or retain them, without obligation to disburse winnings.
3.3 This clause is instituted to preserve the financial integrity and operational sustainability of the Platform.
4. Limitation of Liability
4.1 The Platform shall not be held liable for any direct, indirect, incidental, or consequential losses arising from voided wagers, technical failures, or disputes related to betting outcomes.
4.2 Users waive all rights to initiate claims or legal proceedings against the Platform in relation to lost stakes or voided bets.
4.3 Should any legal action be initiated and subsequently dismissed or ruled in favor of the Platform, the User shall bear full responsibility for all legal costs incurred, including but not limited to attorney fees, court costs, and administrative expenses.
5. Legal Jurisdiction and Enforcement
5.1 The Platform reserves the right to withhold payments or cancel wagers if such actions are deemed necessary to protect its operational viability.
5.2 Any legal proceedings initiated by Users shall be deemed as acceptance of these Terms and shall be governed by the laws of the jurisdiction in which the Platform is domiciled.
5.3 Users agree to submit to the exclusive jurisdiction of the courts located in said jurisdiction and waive any objection to venue or forum non conveniens.
6. Binding Agreement
6.1 Registration, account creation, or continued use of the Platform constitutes full and unconditional acceptance of these Terms and Conditions.
6.2 No partial or conditional acceptance shall be recognized. All provisions herein apply to all aspects of Platform usage, including but not limited to wagering, dispute resolution, and account management.
6.3 Users reaffirm their acceptance upon each login, and any affirmative action (e.g., checkbox selection) shall serve as legal acknowledgment of these Terms.
